The Calcutta High Court has reiterated that two consenting adults have a fundamental right to choose their life partners irrespective of their religion. The court was hearing a petition filed by Abdul Sheikh seeking protection for himself and his partner.
In its order, the court directed the West Bengal Police to provide protection to the interfaith couple. The judgment was delivered in the case of Abdul Sheikh v State of West Bengal, cited as 2026 LiveLaw (Cal) 298.
The court emphasized that the right to choose a life partner is a fundamental right, and the police are duty-bound to protect couples facing threats from family or others.
